Coming home along High St. used to be such a pleasure. Now I see the older homes crowded out by over-buidling.
It is true that much of this could be prevented by better zoning laws, but there seems to be no interest on the part of city government in addressing the zoning laws. The last time I remember anything being done in that area was when the City Council tried to tackle the question of additions to existing structures.Christina Bellingernoreply@blogger.comtag:blogger.com,1999:blog-1314477133804379529.post-79021298211662633952013-03-15T00:57:31.122-04:002013-03-15T00:57:31.122-04:00Thanks for this, Ed. Your political career will be over. Seriously, you liberals need to start pulling your weight in this country, and there is no better place to start than shoveling me out.

My floors need vacuuming, too. Enjoyed your last Blog on Castles. The En...Ed,

Enjoyed your last Blog on Castles. The English common law evolved in a largely rural environment, in which one person's "Castle" was relatively remote from the "Castles" of neighbors. Nonetheless, as far back as the 13th century A.D. it was recognized that the owner of an "estate" in land had obligations not to harm the "estate" of others. With urbanization, and suburbanization in the United States, local zoning plus state and national building codes evolved to balance rights and duties. Local historic districts create a distinct but related process, if approved in specific communities: local community volunteers work with property owners, implementing community-approved guidelines to balance liberties to use one's own property as one wishes with community benefits from shared architectural and historical heritages.

Two classic commentaries indicate a longstanding commitment that property "rights" cannot be considered in isolation from concurrent property "duties" to minimize harm to the property of neighbors:

Henry of Bracton, in 13th century England: "No one may do in his own estate any thing whereby damage or nuisance may happen to his neighbor."

William Blackstone, Commentaries on the Laws of England (1753): "... If one does any other act, in itself lawful, which yet being done in that place necessarily tends to the damage of another's property, it is a nuisance: for it is incumbent on him to find some other place to do that act, where it will be less offensive..."

Bill HarrisAnonymousnoreply@blogger.comtag:blogger.com,1999:blog-1314477133804379529.post-26340686162290833272012-10-17T20:20:15.106-04:002012-10-17T20:20:15.106-04:00Tom was a true gentleman in every way. It all sounds so wonderful! Sustainable development. Historic preservation.Smart growth. But each of these, and others, are designed, some as agenda 21 initiatives, to take away the rights of private homeowners. What is crazy or scary? Not the fact that Agenda 21 was discussed in NBPT, but rather the "head-in-the-sand" mentality that would rather give up individual liberties than stand up for them.
http://www.democratsagainstunagenda21.com/colleen fallonnoreply@blogger.comtag:blogger.com,1999:blog-1314477133804379529.post-18722773704504543902012-02-15T07:59:05.104-05:002012-02-15T07:59:05.104-05:00Thanks for speaking up at City Council on this and...Thanks for speaking up at City Council on this and for your continued efforts to learn more.DearNoahandDylanhttps://www.blogger.com/profile/05764306324547827640noreply@blogger.com
